1. Acceptance of Terms

Welcome to Curated Quarters ("Company", "we", "us", or "our"). By accessing or using our website at www.curatedquarters.com (the "Site") and our services (collectively, the "Services"), you ("you", "your", or "Customer") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Curated Quarters.

If you do not agree with any part of these Terms, you must not use our Services. We reserve the right to modify these Terms at any time. Your continued use of the Services following any changes constitutes your acceptance of the new Terms.

Eligibility

To use our Services, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding contract
• Not be prohibited from receiving our Services under applicable laws

2. Description of Services

Curated Quarters specializes in handcrafted, custom furniture and home furnishings. Our Services include:

• Design consultation services
• Custom furniture design and fabrication
• Sale of pre-designed furniture collections
• Interior design services
• Delivery and installation services (where available)

Custom Orders

Custom furniture orders require special consideration:

• All custom designs become property of Curated Quarters unless otherwise agreed in writing
• Custom orders require a 50% non-refundable deposit to commence work
• Design modifications after production begins may incur additional fees
• Production timelines for custom work vary based on complexity (typically 12-24 weeks)

3. Ordering Process

The ordering process consists of the following stages:

3.1 Price Quotes

All price quotes are valid for 30 days from issuance. Quotes are estimates only and may be adjusted if material costs change significantly before order confirmation.

3.2 Order Confirmation

Orders are not considered confirmed until:

1. We receive your signed design approval
2. We receive the required deposit payment
3. We issue an order confirmation email

3.3 Production

Once confirmed:

• Production begins according to our schedule
• We will provide periodic progress updates
• Delays may occur due to material availability or other unforeseen circumstances

3.4 Delivery

Delivery options include:

• Customer pickup at our Asheville, NC workshop
• White-glove delivery service (additional fees apply)
• Freight shipping (customer responsible for final mile delivery)

4. Payment Terms

All payments must be made in U.S. dollars unless otherwise agreed in writing.

4.1 Payment Schedule

• Custom orders: 50% deposit upon order confirmation, 50% balance due before shipping
• In-stock items: Full payment required at time of purchase
• Design services: 50% deposit to begin, balance upon project completion

4.2 Accepted Payment Methods

We accept:

• Visa, MasterCard, American Express
• Bank wire transfers
• Personal checks (must clear before order processing)
• Financing through third-party providers

4.3 Late Payments

Balances not paid within 14 days of due date will incur:

• 1.5% monthly interest charge (18% APR)
• $50 late fee
• Possible storage fees if completion is delayed due to non-payment

5. Returns & Refunds

Due to the custom nature of our work:

5.1 Custom Orders

Custom furniture cannot be returned or refunded except in cases of:

• Material defects (subject to inspection)
• Significant deviation from approved designs

5.2 Standard Collection Items

Pre-designed collection items may be returned within 14 days of delivery:

• Subject to 15% restocking fee
• Customer pays return shipping
• Must be in original, unused condition

5.3 Refund Processing

Approved refunds will be processed within 30 business days and issued to the original payment method.

6. Warranties

6.1 Structural Warranty

All furniture carries a 10-year warranty against structural defects in materials and workmanship under normal residential use.

6.2 Finish Warranty

Finish warranties vary by product:

• Painted finishes: 3 years
• Natural oil finishes: 2 years
• Lacquered finishes: 5 years

6.3 Warranty Exclusions

Warranties do not cover:

• Damage from misuse, accidents, or improper care
• Normal wear and tear
• Commercial or institutional use
• Modifications made after delivery
• Natural variations in wood grain or color

7. Limitation of Liability

In no event shall Curated Quarters be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use or alteration of your transmissions or content

Our total liability for any claims under these Terms shall not exceed the amount you paid us to use the applicable Service(s) in the 12 months preceding the claim.

8. Intellectual Property

8.1 Ownership

All designs, drawings, specifications, and other materials we create remain our exclusive property unless otherwise agreed in writing.

8.2 License

We grant you a limited, non-exclusive license to use our designs solely for your personal, non-commercial use in connection with products purchased from us.

8.3 Restrictions

You may not:

• Reproduce, modify, or create derivative works of our designs
• Use our designs for commercial purposes
• Have our designs fabricated by third parties
• Remove any copyright or proprietary notices

9. Dispute Resolution

9.1 Negotiation

Before initiating any formal proceedings, both parties agree to attempt to resolve disputes through good faith negotiations for at least 30 days.

9.2 Mediation

If negotiation fails, disputes shall be submitted to mediation in Asheville, NC before resorting to arbitration or litigation.

9.3 Governing Law

These Terms shall be governed by the laws of the State of North Carolina without regard to its conflict of law provisions.

9.4 Jurisdiction

Any legal suit, action or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in Buncombe County, North Carolina.

10. General Provisions

10.1 Force Majeure

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, labor disputes, material shortages, or governmental actions.

10.2 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

10.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

10.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10.5 Entire Agreement

These Terms constitute the entire agreement between us regarding our Services and supersede any prior agreements.
